Terms of Use

About these terms

These terms are the agreement between you and Talk Deep for using the Talk Deep app and the website at talkdeep.me. Talk Deep is run by an independent developer. By using Talk Deep you agree to these terms. If you do not agree, please do not use it.

How we handle your data is described in the Privacy Policy.

Using Talk Deep

We give you a personal, non-exclusive, non-transferable licence to use Talk Deep for your own, non-commercial use, for as long as you follow these terms.

  • Do not copy, resell or republish the questions, decks, games or artwork.
  • Do not try to break, overload or get around the technical limits of the service, and do not access it by automated means.
  • Do not use Talk Deep to harass, threaten or harm anyone, or for anything unlawful.

Accounts

You do not need an account to play on your own, to pass one phone around, or to buy something. You need one, through Sign in with Apple or Google sign-in, for online rooms and for the daily question you share with a partner.

You must be at least 13 years old (16 in the EEA and the UK where that age applies) to create an account. You are responsible for what happens under your account. You can delete it at any time in the app: Profile, then Account, then Delete account.

Purchases and subscriptions

Some decks and games are free. Others need a purchase. Depending on what is offered to you, that is a monthly or yearly subscription, or a one-time purchase (a single deck, a bundle of decks, or lifetime access). The price and what it unlocks are shown before you buy.

  • Payment. In the app, payment is charged to your App Store or Google Play account when you confirm the purchase. On the website, payment is handled by Stripe.
  • Renewal. A subscription renews automatically for the same period and at the then current price, unless you cancel at least 24 hours before the end of the current period. Your store account is charged for the renewal within 24 hours before the period ends.
  • Free trial. Where a free trial is offered, it turns into a paid subscription when it ends, unless you cancel at least 24 hours before the end of the trial.
  • Managing and cancelling. Manage or cancel a subscription in your App Store or Google Play account settings. Deleting the app or your Talk Deep account does not cancel a store subscription. A subscription bought on the website is managed through the billing page we link you to, or by writing to us.
  • One-time purchases. They are yours to keep and do not renew.
  • Price changes. If the price of your subscription changes, you are told in advance in the way your store requires, and you can cancel before the new price applies.
  • Refunds. Refunds for purchases made in the app are handled by Apple or Google under their policies, and for purchases on the website through Stripe. Any right to withdraw or to a refund that the law of your country gives you is not affected.

Rooms, names and other players

In online rooms and in the daily question, the name and character you choose and what you answer are shown to the people you play with. Choose names that are not offensive, hateful, sexually explicit or harassing, and do not pretend to be someone else.

A host may remove a team or player where the game allows it. We may remove content, close rooms or suspend accounts that break these rules. To report a problem, write to hello@talkdeep.me.

The questions are not advice

Talk Deep is a game. The questions, including the decks about relationships, are there to start conversations. They are for entertainment and are not professional advice of any kind, whether psychological, medical, legal or relationship counselling. You decide what you share and with whom.

Our content

The app, the website, the questions, decks, games, artwork and the Talk Deep name belong to us or to our licensors. These terms give you no rights in them beyond the licence above.

Changes to the service

We may add, change or remove decks, games and features, and we may stop offering Talk Deep. If we end a paid feature you have already paid for, the rights the law of your country gives you in that case stay in place.

No warranty

We work to keep Talk Deep running and correct, but it is provided as it is and as available. To the extent the law allows, we make no promise that it will always be available, free of errors or fit for a particular purpose. Rights you have as a consumer that cannot be excluded by agreement are not affected.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, and our total liability to you is limited to the amount you paid us for Talk Deep in the 12 months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

Ending

You can stop using Talk Deep and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms. The sections that by their nature should continue (our content, no warranty, liability, law) stay in force after that.

If you got the app from the App Store

These points apply to the iPhone app, and Apple requires us to state them.

  • These terms are between you and Talk Deep. Apple is not a party to them and is not responsible for the app or its content.
  • The licence is limited to using the app on Apple devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet a warranty that applies, you may tell Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for any claim about the app, including product liability claims, claims that it fails to meet a legal requirement, consumer protection and privacy claims, and claims that it infringes someone’s intellectual property rights.
  • You confirm that you are not in a country under a United States government embargo or named by it as supporting terrorism, and that you are not on a United States government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Law and disputes

The mandatory consumer protection law of the country where you live applies to these terms, and nothing in them takes away rights that law gives you. You may bring a claim in the courts of the country where you live.

If something goes wrong, write to hello@talkdeep.me first. Most problems can be fixed that way.

Changes to these terms

We may update these terms. When we do, we change the date at the top. If a change is significant we will say so in the app or on this page before it takes effect. If you keep using Talk Deep after that, the new terms apply.
